Terms and conditions

Last updated: 19 October 2026

In plain English: you get a written quote before any work starts. Work begins once you accept it and pay the deposit. You own the final approved designs once everything is paid. Please check proofs carefully, because you sign them off. If you’re an individual rather than a business, you have extra legal rights that these terms don’t take away.

These terms apply to all design and creative services provided by BMB Creative, the trading name of Nick Lowe a sole trader of BMB Creative (“we”, “us”). “You” means the person or organisation we are working for. Please read them together with your quote, our refund and cancellation policy and our privacy policy.

1. The agreement

  1. 1.1Our agreement with you is made up of your accepted quote or proposal and these terms. If they conflict, the quote applies.
  2. 1.2The agreement starts when you accept the quote in writing (email is fine) and, where a deposit is due, we receive it.
  3. 1.3Any other terms you send us, such as on a purchase order, don’t apply unless we agree to them in writing.
  4. 1.4Some parts of these terms apply differently depending on whether you are a business client (a company, organisation, charity, public body or sole trader buying for their business) or a consumer (an individual buying for personal use). Where that matters, we say so.

2. Quotes and scope

  1. 2.1Every project starts with a written quote setting out what we will deliver, the price, the number of revision rounds included and an expected timescale.
  2. 2.2Quotes are valid for 30 days.
  3. 2.3The price covers only the work described in the quote. Anything extra is quoted separately and only carried out once you agree to it.
  4. 2.4Unless the quote says otherwise, prices don’t include printing, stock images, font licences, hosting, domain names or other third-party costs.
  5. 2.5 Prices are subject to VAT. If we become VAT-registered, VAT will be added at the current rate and we’ll tell you before it applies to your work.

3. Fees and payment

  1. 3.1A deposit of 50% of the project price is due before work starts. The balance is due on completion, before final files are released, unless your quote sets out staged payments.
  2. 3.2Invoices are payable within 14 days by bank transfer to the account shown on the invoice.
  3. 3.3If a project is put on hold by you for more than 30 days, we may invoice for the work completed so far.
  4. 3.4If an invoice is overdue, we may pause work until it is paid. For business clients, we may also charge interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998.
  5. 3.5Final artwork and files are released once all invoices for the project have been paid in full.

4. Third-party costs

  1. 4.1If we buy items on your behalf, such as printing, stock photography, fonts or hosting, we will agree the cost with you first. We may ask you to pay for them in advance.
  2. 4.2Third-party products are supplied on the supplier’s own terms. We’ll help you deal with any problem, but we aren’t responsible for a supplier’s errors or delays.

5. Your responsibilities

  1. 5.1You agree to give us a clear brief and to provide the text, images, logos, information and feedback we need, on time.
  2. 5.2You confirm that you own, or have permission to use, everything you send us, and that it doesn’t break any law or anyone else’s rights. If you are a business client, you agree to cover any losses we suffer because something you supplied breaks this promise.
  3. 5.3You are responsible for the accuracy of the content you provide, and for making sure the final work meets any legal or regulatory requirements of your sector, such as advertising rules or product claims.
  4. 5.4Please name one person to give feedback and approvals, so instructions are clear.

6. Timescales

  1. 6.1We will do our best to meet the timescales in your quote. Timescales depend on receiving content, feedback and payments when agreed, and will move if these are late.
  2. 6.2Where a fixed deadline really matters, such as a print date or launch, please tell us at the start so we can confirm in writing whether it can be met.

7. Revisions and changes

  1. 7.1Your quote says how many rounds of revisions are included. If it doesn’t, two rounds are included. A round is one set of combined feedback on a draft.
  2. 7.2Further revisions, or changes to the brief once work has started, are charged at £70 per hour or as quoted. We will always tell you the cost and get your agreement first.

8. Proofs and approval

  1. 8.1We take care to get things right, but it is your responsibility to check final proofs thoroughly, including spelling, figures, contact details, dates, colours and legal wording, before approving them.
  2. 8.2Once you approve a proof for print or publication, we aren’t responsible for errors in it. Correcting them afterwards, and any reprint, will be charged.
  3. 8.3Colours vary between screens, printers and materials. We will advise on this, but printed colours can’t be guaranteed to match a screen exactly.

9. Ownership of the work

  1. 9.1Once you have paid all invoices for the project, the copyright and other intellectual property rights in the final approved designs pass to you. You are free to use, change and reproduce them.
  2. 9.2Until then, the rights stay with us. You may use drafts only to review the work.
  3. 9.3Concepts, sketches and alternative designs that you don’t choose remain ours and may be used for other purposes. They will never include your name, logo or confidential information.
  4. 9.4We supply final artwork in the formats listed in your quote. Editable working files, such as layered design files, are not included unless the quote says so. They can be supplied for an additional fee.
  5. 9.5We keep the general know-how, techniques and reusable elements (such as templates or code) we bring to the project. You receive a permanent licence to use any of these that form part of your final work.
  6. 9.6For logos and brand identities, we recommend you check that the name and design are free to use and, if needed, register them as trade marks. We can’t guarantee that a new name or logo doesn’t conflict with someone else’s rights.

10. Third-party materials

  1. 10.1Work may include fonts, stock images, icons, plugins or other materials owned by others. These are licensed rather than owned, and their own licence terms apply.
  2. 10.2We will tell you about any licence that limits how you can use the work, or that you need to buy or renew in your own name.

11. Showing the work

  1. 11.1Once your project is public, we may show it in our portfolio, on our website and social media, and in award entries, and name you as the client.
  2. 11.2If you would rather we didn’t, or the work is confidential, just tell us before the project starts and we will respect that.
  3. 11.3We will only quote feedback from you, or use your name with a testimonial, with your permission.

12. Confidentiality

  1. 12.1We will keep your confidential information private, use it only for your project and not share it except with suppliers who need it to do the work, or where the law requires us to.
  2. 12.2We handle personal information as explained in our privacy policy. If we process personal data on your behalf, such as a mailing list for a campaign, we will agree data protection terms with you.

13. Design Partner arrangements

  1. 13.1Ongoing support is provided as set out in your Design Partner agreement, including the monthly fee, the time or work included and how requests are made.
  2. 13.2Fees are billed monthly in advance. Unused time doesn’t carry over to the next month unless your agreement says so.
  3. 13.3Either of us can end the arrangement with 30 days written notice. Work in progress at the end will be completed or invoiced on a fair basis.

14. Websites and digital work

  1. 14.1Websites are built to work on current versions of the major browsers and devices at the time of launch.
  2. 14.2Hosting, domain names, email, updates, security and backups are not included unless agreed in writing. Third-party platforms and plugins can change outside our control.
  3. 14.3You are responsible for the content you publish, and for your own website policies such as privacy and cookies, unless we have agreed to provide them.

15. Cancelling or ending the work

  1. 15.1Cancellations and refunds are covered by our refund and cancellation policy. Consumers have a 14-day right to cancel, explained there.
  2. 15.2Either of us may end the agreement by written notice if the other seriously breaks these terms and doesn’t put it right within 14 days of being asked to.
  3. 15.3If the agreement ends, you pay for work completed up to that date, and you receive the rights in any work you have paid for.

16. Our liability

  1. 16.1Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can’t legally be limited.
  2. 16.2If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of us breaking this agreement or failing to use reasonable care and skill. Nothing in these terms affects your legal rights under the Consumer Rights Act 2015.
  3. 16.3If you are a business client:
    • we aren’t liable for loss of profit, revenue, business, goodwill or data, or for any indirect or consequential loss; and
    • our total liability under or in connection with the agreement is limited to the total fees you have paid for the project concerned.
  4. 16.4We aren’t responsible for problems caused by content or instructions you provide, by errors in proofs you have approved, or by third-party suppliers, platforms or software.

17. Events outside our control

  1. 17.1Neither of us is responsible for delays or failures caused by events outside our reasonable control, such as serious illness, extreme weather, power or internet failure, or the failure of a supplier. We will tell you as soon as possible and agree a revised timescale.

18. Complaints

  1. 18.1If you are unhappy with any part of our work, please tell us as soon as possible by emailing brandmybusinessuk@gmail.com. We will reply within 5 working days and do our best to put things right.

19. General

  1. 19.1We may use trusted freelancers or suppliers to help deliver the work. We remain responsible for their work for you.
  2. 19.2You may not transfer your rights under the agreement without our written agreement.
  3. 19.3If a court finds part of these terms can’t be enforced, the rest still applies.
  4. 19.4If we don’t enforce a right straight away, we can still enforce it later.
  5. 19.5We may update these terms from time to time. The version on this page when you accept your quote is the one that applies to your project.
  6. 19.6These terms are governed by the law of England and Wales, and the courts of England and Wales will deal with any dispute. If you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
